Overview
This website is operated by Brim Domain. Throughout the site, the terms “Brim Domain,” “we,” “us,” and “our” refer to Brim Domain and, where applicable, its owners, officers, employees, agents, affiliates, successors, and assigns. Brim Domain offers this website, including all information, tools, products, and services available through the site, to you conditioned upon your acceptance of these Terms of Service and all policies referenced in them.
Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products and services to you. These Terms govern your access to and use of shopbrimdomain.com (the “Site”), your purchase of products, and your use of services offered by Brim Domain.
By visiting the Site, creating an account, submitting an order, purchasing a product or service, or otherwise using any part of the Site, you agree to be bound by these Terms of Service. If you do not agree, you may not access the Site or use our services.
These Terms should be read together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policy or notice posted on the Site.
1. Eligibility and Online Store Terms
By using the Site, you represent that you are at least the age of majority in your state or place of residence. If you permit a minor dependent to use the Site, you accept responsibility for that use.
You may not use our products, services, or Site for any illegal or unauthorized purpose, and you may not violate any applicable law, regulation, or third-party right. You may not transmit malware, viruses, destructive code, or other material intended to interfere with the Site or another person’s use of it.
A violation of these Terms may result in the suspension or termination of your access to the Site or cancellation of an order, subject to applicable law.
2. Products and Services
Brim Domain may offer products and services including blank hats, custom hats, apparel, heat-transfer patches, embroidered patches, sticker patches, hat pins, hat charms, bandanas, skull caps, accessories, and hat-cleaning or restoration services.
Products and services may be available exclusively online, in limited quantities, by appointment, or at a Brim Domain retail or event location. We may limit sales by person, household, geographic region, or jurisdiction when reasonably necessary, subject to applicable law.
We may modify, discontinue, or limit a product or service at any time. Product availability is not guaranteed. Any offer is void where prohibited.
3. Product Information and Display
We work to present product descriptions, dimensions, colors, images, and other details accurately. However, colors and appearance may vary because of screen settings, lighting, materials, production batches, or the natural characteristics of a product. Measurements may be approximate.
We do not guarantee that every image or description will be completely accurate, current, or error-free. If a product materially differs from its description, your remedy will be governed by our Refund Policy and applicable law.
4. Orders, Acceptance, and Cancellation
Your order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance. We may accept, decline, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, inability to verify payment or shipping information, product unavailability, suspected resale activity, prohibited customization requests, or violations of these Terms.
If we cancel an order after payment has been captured, we will issue a refund to the original payment method, subject to processing times outside our control.
You agree to provide current, complete, and accurate billing, shipping, payment, and account information. You are responsible for reviewing all order details before submitting your order and for promptly updating information when necessary.
Once an order enters production, customization, fulfillment, or shipment, it may not be changed or canceled except as stated in our Refund Policy or required by law.
5. Prices, Payments, Taxes, and Promotions
Prices are shown in U.S. dollars unless otherwise stated. Prices, promotions, discounts, and product availability may change without notice before an order is placed.
You agree to pay all charges shown at checkout, including applicable taxes, shipping fees, service fees, and other disclosed charges. By providing payment information, you represent that you are authorized to use the selected payment method.
Promotional offers may be subject to separate terms, expiration dates, product exclusions, quantity limits, and restrictions on combining discounts. Unless required by law, promotions are not redeemable for cash and may not be applied retroactively.
If a product is listed at an incorrect price because of an error, we may cancel the affected order and refund any amount paid, subject to applicable law.
6. Custom Products and Customer-Submitted Content
Custom, personalized, altered, embroidered, printed, patched, or otherwise made-to-order products are produced according to the information and approvals you provide. You are responsible for checking spelling, sizing, colors, placement, artwork, and other customization details before approving an order or proof.
Minor variations in placement, stitching, color, scale, texture, or finish may occur and are not necessarily defects. Custom products may be final sale or subject to limited remedies as described in our Refund Policy, except where a product is defective, materially different from the approved design, or otherwise covered by applicable law.
If you submit a name, logo, image, artwork, phrase, trademark, likeness, or other content for customization, you represent that you own it or have all permissions necessary for Brim Domain to reproduce and use it to complete your order. You grant Brim Domain a limited, nonexclusive license to use the submitted content solely to review, produce, fulfill, document, and provide customer service for your order.
We may refuse or cancel customization requests that we reasonably believe are unlawful, infringing, deceptive, threatening, hateful, obscene, unsafe, or otherwise inappropriate. You are responsible for claims arising from content you submit or direct us to use.
7. Hat-Cleaning and Restoration Services
Before submitting a hat for cleaning or restoration, you must disclose known damage, color bleeding, loose decorations, prior repairs, fragile materials, mold, hazardous contamination, or other unusual conditions. We may inspect and decline any item that we believe cannot be treated safely or effectively, including hats with heavy mold, burns, melted materials, severe structural failure, or hazardous contamination.
Cleaning and restoration results vary based on age, construction, fabric, dyes, adhesives, prior treatments, stains, odors, wear, and damage. We do not guarantee complete stain or odor removal, exact color restoration, or a like-new result.
You acknowledge that cleaning and restoration involve reasonable risks, including color change or bleeding, shrinkage, texture change, loosening of adhesives or decorations, brim or crown changes, and the discovery or worsening of pre-existing damage. Brim Domain will use reasonable care but is not responsible for unavoidable results caused by an item’s materials, construction, age, prior condition, hidden defects, or inaccurate information supplied by the customer, except to the extent liability cannot be excluded under applicable law.
Service time estimates are estimates only and may change after inspection. Additional work or charges will not be performed without your approval when approval is reasonably required.
If you ship an item to us, you are responsible for packaging it appropriately and following the instructions provided. Risk relating to carriers is governed by our Shipping Policy and applicable law. Any claim concerning loss of or damage to an item while it is in Brim Domain’s possession must be submitted promptly with proof of ownership and value.
8. Shipping, Delivery, Pickup, and Risk of Loss
Shipping and delivery estimates are not guarantees. Delays may occur because of carriers, weather, demand, customs, incorrect addresses, or events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. If an order is returned because of an incorrect address, failed delivery, refusal, or failure to collect it, you may be responsible for reasonable reshipping costs where permitted by law.
Shipping, delivery, local pickup, lost-package procedures, and any applicable risk-of-loss terms are further described in our Shipping Policy. Nothing in these Terms limits rights that cannot legally be waived.
9. Returns, Refunds, and Exchanges
Returns, refunds, exchanges, store credits, damaged-item claims, and nonreturnable products are governed by our Refund Policy in effect at the time of purchase. Please review that policy before ordering.
Custom or personalized goods, worn or used merchandise, and completed services may be ineligible for return or may have special conditions, except when required by law or expressly allowed by our Refund Policy.
10. Accounts and Account Security
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account. Notify us promptly at brimdomain@gmail.com if you suspect unauthorized access.
We may suspend or terminate accounts used fraudulently, unlawfully, or in violation of these Terms. We are not responsible for losses caused by your failure to protect account credentials, except where prohibited by law.
11. Reviews, Feedback, and Other Submissions
If you submit a review, photo, comment, suggestion, idea, testimonial, or other content, you represent that the submission is accurate, lawful, and does not violate another person’s privacy, publicity, intellectual-property, or other rights.
You grant Brim Domain a worldwide, nonexclusive, royalty-free license to use, reproduce, edit, publish, display, and distribute that content in connection with our business, marketing, and Site, unless prohibited by law. This license does not transfer ownership of your content to us.
We may remove content that violates these Terms or is fraudulent, unlawful, abusive, or unrelated to the relevant product or service. We are not obligated to keep submissions confidential unless we expressly agree otherwise in writing.
12. Intellectual Property
The Site and its content—including the Brim Domain name, logos, original designs, text, graphics, product photography, videos, layouts, and other materials—are owned by or licensed to Brim Domain and are protected by applicable intellectual-property laws.
You may access the Site for personal, noncommercial shopping purposes. You may not copy, reproduce, modify, distribute, sell, license, scrape, frame, publish, create derivative works from, or commercially exploit Site content without prior written permission from Brim Domain or the applicable rights holder.
Third-party names, logos, brands, characters, artwork, and trademarks displayed on products or the Site remain the property of their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation unless expressly stated.
If you believe content on the Site infringes your intellectual-property rights, contact us at brimdomain@gmail.com with enough information for us to identify and evaluate the material and your claim.
13. Prohibited Uses
You may not use the Site or its content to:
violate any law, regulation, court order, or third-party right;
commit fraud, impersonate another person, or submit false information;
infringe intellectual-property, privacy, publicity, or contractual rights;
harass, threaten, abuse, discriminate against, or harm another person;
upload malware or interfere with the Site’s security or operation;
collect or track personal information without authorization;
send spam, phish, scrape, crawl, or use automated systems in a way that burdens or disrupts the Site;
bypass security, access controls, purchasing limits, or other protective measures; or
resell products in violation of an expressly stated restriction.
We may investigate suspected violations and cooperate with lawful authorities when required.
14. Third-Party Services and Links
The Site may use or link to third-party platforms, payment processors, shipping carriers, applications, social media services, or websites. Those third parties may have their own terms and privacy practices.
We are not responsible for third-party content, services, availability, policies, or actions. Your use of a third-party service is at your own discretion and may be governed by separate agreements between you and that provider.
15. Privacy
Our collection and use of personal information are described in our Privacy Policy. Shopify and other service providers may also process information to operate the Site, checkout, payments, analytics, communications, and related services.
16. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and all information, products, and services are provided “as is” and “as available,” except for any express warranty we provide in writing. We do not warrant that the Site will always be uninterrupted, secure, timely, or error-free, or that every product or service will meet every customer’s subjective expectations.
We disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and noninfringement, to the fullest extent permitted by law. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
Nothing in these Terms excludes or limits any warranty, consumer guarantee, or other right that cannot legally be excluded or limited.
17. Limitation of Liability
To the fullest extent permitted by law, Brim Domain will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, lost data, replacement costs, or similar damages arising from your use of the Site or purchase or use of a product or service.
To the fullest extent permitted by law, Brim Domain’s total liability for a claim arising from a specific transaction will not exceed the amount you paid to Brim Domain for the product or service giving rise to the claim.
These limitations do not apply to liability that cannot be limited by law, including liability arising from fraud, willful misconduct, or other legally nonwaivable conduct. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
18. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Brim Domain and its owners, officers, employees, agents, affiliates, service providers, licensors, successors, and assigns from third-party claims, losses, liabilities, damages, and reasonable costs arising from your violation of these Terms, your unlawful use of the Site, or content or customization materials you submit.
This section does not require you to indemnify any party for that party’s own fraud, willful misconduct, or other conduct for which indemnification is prohibited by law.
19. Errors, Inaccuracies, and Omissions
The Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability. We may correct errors and update information at any time. If an error materially affects an accepted order, we will provide any notice or remedy required by applicable law.
20. Changes to the Site and These Terms
We may update the Site, products, services, and these Terms from time to time. The current version will be posted on this page with its effective date. Changes will apply prospectively when posted or on a later date stated in the revised Terms.
When required by law, we will provide additional notice or obtain consent. Your continued use of the Site after revised Terms take effect means that you accept them.
21. Suspension and Termination
You may stop using the Site at any time. We may suspend or terminate access to the Site if you violate these Terms, create legal or security risk, engage in fraud or abuse, or misuse our services.
Termination does not eliminate payment obligations or other provisions that by their nature should survive, including intellectual-property, disclaimer, liability, indemnification, dispute, and enforcement provisions.
22. Governing Law and Disputes
These Terms and any separate agreement under which Brim Domain provides products or services will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection laws apply.
Before filing a lawsuit, you and Brim Domain agree to make a good-faith effort to resolve the dispute informally by sending written notice describing the issue and requested resolution. Notices to Brim Domain must be sent to brimdomain@gmail.com. If the dispute is not resolved informally, either party may pursue any remedy available under applicable law.
Nothing in this section prevents either party from bringing an eligible claim in small claims court or seeking urgent injunctive relief. These Terms do not require arbitration and do not waive any right to a jury trial or class proceeding unless the parties later agree in a separate written agreement.
23. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.
24. Waiver
Our failure to enforce a provision of these Terms is not a waiver of that provision or our right to enforce it later.
25. Entire Agreement
These Terms and the policies and notices posted on the Site form the entire agreement between you and Brim Domain concerning the Site and the products and services covered by them. They replace prior or contemporaneous communications concerning the same subject.
Any ambiguity in these Terms will not automatically be interpreted against the party that drafted them.
